1. Acceptance of Terms

Welcome to My Skin Scanner. These Terms of Use ("Terms") are a binding agreement between you ("User," "you," or "your") and My Skin Scanner ("we," "us," or "our") regarding your use of the My Skin Scanner mobile application (the "App").

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1.1 Age Requirement

You must be at least 13 years old to use My Skin Scanner. If you are between 13 and 18 (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission. By using the App, you represent that you meet the age requirement and have authority to accept these Terms.

2. Description of Service

2.1 What My Skin Scanner Is

My Skin Scanner is a mobile application that provides:

• AI-powered analysis of skin photos you take or upload
• Reports and insights on skin concerns (e.g., acne, dryness, dark spots, aging, sensitivity)
• Personalized tips and the ability to save and track scans over time

2.2 Platform Availability

My Skin Scanner is available on iOS and Android through the Apple App Store and Google Play Store, subject to each platform’s requirements.

2.3 What My Skin Scanner Is Not

My Skin Scanner is not:

• Medical advice, diagnosis, or treatment
• A substitute for a licensed dermatologist or healthcare provider
• A guarantee of any specific skin outcome
• Intended to treat, cure, or prevent any skin condition

For any medical or skin-health decisions, consult a qualified healthcare provider.

3. User Responsibilities

3.1 Proper Use

You agree to use the App only for personal, non-commercial skin insight and tracking. You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Upload photos of anyone else without their consent, or of minors without parental consent
• Reverse engineer, decompile, or disassemble the App
• Copy, modify, or create derivative works of the App
• Use the App to harm, harass, or infringe the rights of others
• Attempt to gain unauthorized access to our systems or networks

3.2 Permissions

The App may request access to your camera, photo library, and (optionally) location (e.g., to tag where a photo was taken). You are responsible for granting or denying these permissions. Some features may not work without them.

3.3 Account and Subscription Security

If you subscribe, your subscription is tied to your Apple ID or Google account. You are responsible for keeping that account secure and for all activity under it.

4. Subscription Terms

4.1 Subscription Plans

My Skin Scanner may offer free and premium (subscription) plans. Premium typically includes unlimited skin scans, full AI reports, progress tracking, and other features as described in the App.

4.2 Free Trial

We may offer a free trial. If you do not cancel before the trial ends, you may be automatically charged for the subscription according to the offer terms.

4.3 Billing

Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the renewal date. Payment is processed through your Apple ID or Google account.

4.4 Cancellation

You may cancel your subscription at any time through your device’s app store account settings. Cancellation takes effect at the end of the current billing period. You keep access to premium features until then.

4.5 Refunds

Refunds are handled by Apple or Google according to their policies (e.g., Apple Refund Policy). We cannot issue refunds directly.

4.6 Price Changes

We may change subscription prices. Price changes will apply at the start of your next billing period after we notify you. If you do not agree, you may cancel before the change takes effect.

5. Intellectual Property

5.1 Ownership

My Skin Scanner and its content, features, and functionality (including software, text, images, graphics, logos, and AI models) are owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.

5.2 License to Use Your Photos

You grant us a limited license to use, process, and store the photos you submit only as necessary to provide the skin analysis and related features (e.g., generating reports, improving the service). We do not claim ownership of your photos. Our use is subject to our Privacy Policy.

5.3 Limited License to You

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use in accordance with these Terms.

5.4 Restrictions

You may not copy, modify, distribute, sell, or lease any part of the App, or remove any proprietary notices, without our written permission.

6. Disclaimers and Limitations of Liability

6.1 "As Is"

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

6.2 Not Medical Advice

My Skin Scanner does not provide medical advice. The analysis and reports are for informational and educational purposes only. We do not guarantee accuracy, and results are not a diagnosis. Always consult a healthcare provider for medical decisions.

6.3 No Guarantee of Results

We do not guarantee that using the App will improve your skin, accurately identify conditions, or produce any specific outcome. Results vary. The App is a tool, not a guarantee.

6.4 Technical Disclaimers

We do not warrant that the App will be uninterrupted, secure, or error-free, or that it will work on all devices or operating systems. We are not responsible for any harm resulting from reliance on the App.

6.5 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OR INABILITY TO USE THE APP, UNAUTHORIZED ACCESS, INTERRUPTION, BUGS, OR ANY HARM FROM RELYING ON THE APP’S CONTENT.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $100, WHICHEVER IS LESS.

7. Indemnification

You agree to indemnify, defend, and hold harmless My Skin Scanner and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights or laws.

8. Termination

8.1 Our Right to Terminate

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

8.2 Your Right to Stop Use

You may stop using the App at any time by uninstalling it. To cancel your subscription, use your app store account settings as described in Section 4.4.

8.3 Effect of Termination

On termination, your right to use the App ends. You will not receive a refund for any unused subscription period. Data on your device remains until you delete it or uninstall the App.

9. Changes to Terms

We may modify these Terms at any time. We will update the "Last Updated" date and may notify you in the App or on our website. Your continued use after changes constitutes acceptance. For material changes, we may give at least 30 days’ notice and require you to accept the new Terms to continue.

10. Governing Law and Disputes

These Terms are governed by the laws of the United States and the state in which we operate, without regard to conflict of law principles. Any dispute will first be addressed by contacting us at contact@easy-carb.site. If unresolved, disputes may be resolved by binding arbitration in accordance with applicable rules; you waive the right to a jury trial and to participate in a class action, to the extent permitted by law.

11. General

These Terms, together with our Privacy Policy, constitute the entire agreement between you and My Skin Scanner regarding the App. If any provision is invalid or unenforceable, the rest remains in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our consent; we may assign without restriction.

12. App Store Terms

If you download the App from the Apple App Store or Google Play, you agree that these Terms are between you and us, not Apple or Google. Apple and Google have no obligation to support the App. You must comply with their respective terms of service.

14. Acknowledgment

BY DOWNLOADING, INSTALLING, OR USING MY SKIN SCANNER, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE, DO NOT USE THE APP.
